A BILL
To amend section 4501.21 and to enact section 4503.74 1
of the Revised Code to create "Mahoning River" 2
license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.74 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.50, 4503.51, 4503.55, 4503.561, 4503.591, 4503.67, 4503.68, 10
4503.69, 4503.71, 4503.711, 4503.72, 4503.73, 4503.74, and 4503.75 11
of the Revised Code.12

       (B) The registrar shall disburse the contributions the 13
registrar collects in the fund as follows:14

       (1) The registrar shall pay the contributions the registrar 15
receives pursuant to section 4503.50 of the Revised Code to the 16
future farmers of America foundation, which shall deposit the 17
contributions into its general account to be used for educational 18
and scholarship purposes of the future farmers of America 19
foundation.20

       (2) The registrar shall pay each contribution the registrar 21
receives pursuant to section 4503.51 of the Revised Code to the 22
university or college whose name or marking or design appears on 23
collegiate license plates that are issued to a person under that 24
section. A university or college that receives contributions from 25
the fund shall deposit the contributions into its general 26
scholarship fund.27

       (3) The registrar shall pay the contributions the registrar 28
receives pursuant to section 4503.55 of the Revised Code to the 29
pro football hall of fame, which shall deposit the contributions 30
into a special bank account that it establishes and which shall be 31
separate and distinct from any other account the pro football hall 32
of fame maintains, to be used exclusively for the purpose of 33
promoting the pro football hall of fame as a travel destination.34

       (4) The registrar shall pay the contributions the registrar 35
receives pursuant to section 4503.561 of the Revised Code to the 36
state of Ohio chapter of ducks unlimited, inc., which shall 37
deposit the contributions into a special bank account that it 38
establishes. The special bank account shall be separate and 39
distinct from any other account the state of Ohio chapter of ducks 40
unlimited, inc., maintains and shall be used exclusively for the 41
purpose of protecting, enhancing, restoring, and managing wetlands 42
and conserving wildlife habitat. The state of Ohio chapter of 43
ducks unlimited, inc., annually shall notify the registrar in 44
writing of the name, address, and account to which payments are to 45
be made under division (B)(4) of this section.46

       (5) The registrar shall pay to a sports commission created 47
pursuant to section 4503.591 of the Revised Code each contribution 48
the registrar receives under section 4503.591 of the Revised Code 49
that an applicant pays to obtain license plates that bear the logo 50
of a professional sports team located in the county of that sports 51
commission and that is participating in the license plate program 52
established by section 4503.591 of the Revised Code, irrespective 53
of the county of residence of an applicant.54

       (6) The registrar shall pay the contributions the registrar 55
receives pursuant to section 4503.67 of the Revised Code to the 56
Dan Beard council of the boy scouts of America. The council shall 57
distribute all contributions in an equitable manner throughout the 58
state to regional councils of the boy scouts.59

       (7) The registrar shall pay the contributions the registrar 60
receives pursuant to section 4503.68 of the Revised Code to the 61
great river council of the girl scouts of the United States of 62
America. The council shall distribute all contributions in an 63
equitable manner throughout the state to regional councils of the 64
girl scouts.65

       (8) The registrar shall pay the contributions the registrar 66
receives pursuant to section 4503.69 of the Revised Code to the 67
Dan Beard council of the boy scouts of America. The council shall 68
distribute all contributions in an equitable manner throughout the 69
state to regional councils of the boy scouts.70

       (9) The registrar shall pay the contributions the registrar 71
receives pursuant to section 4503.71 of the Revised Code to the 72
fraternal order of police of Ohio, incorporated, which shall 73
deposit the fees into its general account to be used for purposes 74
of the fraternal order of police of Ohio, incorporated.75

       (10) The registrar shall pay the contributions the registrar 76
receives pursuant to section 4503.711 of the Revised Code to the 77
fraternal order of police of Ohio, incorporated, which shall 78
deposit the contributions into an account that it creates to be 79
used for the purpose of advancing and protecting the law 80
enforcement profession, promoting improved law enforcement 81
methods, and teaching respect for law and order.82

       (11) The registrar shall pay the contributions the registrar 83
receives pursuant to section 4503.72 of the Revised Code to the 84
organization known on the effective date of this sectionMarch 31, 85
2003, as the Ohio CASA/GAL association, a private, nonprofit 86
corporation organized under Chapter 1702. of the Revised Code. The 87
Ohio CASA/GAL association shall use these contributions to pay the 88
expenses it incurs in administering a program to secure the proper 89
representation in the courts of this state of abused, neglected, 90
and dependent children, and for the training and supervision of 91
persons participating in that program.92

       (12) The registrar shall pay the contributions the registrar 93
receives pursuant to section 4503.73 of the Revised Code to Wright 94
B. Flyer, incorporated, which shall deposit the contributions into 95
its general account to be used for purposes of Wright B. Flyer, 96
incorporated.97

       (13) The registrar shall pay the contributions the registrar 98
receives pursuant to section 4503.74 of the Revised Code to the 99
Mahoning river consortium, which shall use the money to pay the 100
expenses it incurs in restoring and maintaining the Mahoning river 101
watershed.102

       (14) The registrar shall pay the contributions the registrar 103
receives pursuant to section 4503.75 of the Revised Code to the 104
rotary foundation, located on the effective date of this section105
March 31, 2003, in Evanston, Illinois, to be placed in a fund 106
known as the permanent fund and used to endow educational and 107
humanitarian programs of the rotary foundation.108

       (C) All investment earnings of the license plate contribution 109
fund shall be credited to the fund. Not later than the first day 110
of May of every year, the registrar shall distribute to each 111
entity described in divisions (B)(1) to (13)(14) of this section 112
the investment income the fund earned the previous calendar year. 113
The amount of such a distribution paid to an entity shall be 114
proportionate to the amount of money the entity received from the 115
fund during the previous calendar year.116

       Sec. 4503.74.  (A) The owner or lessee of any passenger car, 117
noncommercial motor vehicle, motor home, or other vehicle of a 118
class approved by the registrar of motor vehicles may apply to the 119
registrar for the registration of the vehicle and issuance of 120
"Mahoning river" license plates. The application for "Mahoning 121
river" license plates may be combined with a request for a special 122
reserved license plate under section 4503.40 or 4503.42 of the 123
Revised Code. Upon receipt of the completed application and 124
compliance with division (B) of this section, the registrar shall 125
issue to the applicant the appropriate vehicle registration, a set 126
of "Mahoning river" license plates with a validation sticker, or a 127
validation sticker alone when required by section 4503.191 of the 128
Revised Code.129

       In addition to the letters and numbers ordinarily inscribed 130
on the license plates, "Mahoning river" license plates shall be 131
inscribed with identifying words or markings selected by the 132
Mahoning river consortium and approved by the registrar. "Mahoning 133
river" license plates shall bear county identification stickers 134
that identify the county of registration by name or number.135

       (B) "Mahoning river" license plates and a validation sticker 136
or, when applicable, a validation sticker alone shall be issued 137
upon submission by the applicant of an application for 138
registration of a motor vehicle under this section and a 139
contribution as provided in division (C) of this section; payment 140
of the regular license tax as prescribed under section 4503.04 of 141
the Revised Code, any applicable motor vehicle tax levied under 142
Chapter 4504. of the Revised Code, any applicable additional fee 143
prescribed by section 4503.40 or 4503.42 of the Revised Code, and 144
an additional fee of ten dollars; and compliance with all other 145
applicable laws relating to the registration of motor vehicles.146

       (C) For each application for registration and registration 147
renewal that the registrar receives under this section, the 148
registrar shall collect a contribution not exceeding twenty 149
dollars as determined by the Mahoning river consortium. The 150
registrar shall transmit this contribution to the treasurer of 151
state for deposit in the license plate contribution fund created 152
by section 4501.21 of the Revised Code. The Mahoning river 153
consortium may change the amount of the contribution, but such a 154
change shall not be made more frequently than once every twelve 155
months.156

       The additional fee of ten dollars described in division (B) 157
of this section shall be for the purpose of compensating the 158
bureau of motor vehicles for additional services required in 159
issuing license plates under this section. The registrar shall 160
transmit that fee to the treasurer of state for deposit into the 161
state treasury to the credit of the bureau of motor vehicles fund 162
created by section 4501.25 of the Revised Code.163

       Section 2. That existing section 4501.21 of the Revised Code 164
is hereby repealed.165
