A BILL
To enact sections 153.03, 1551.17, 3313.377, and 1
3314.042 of the Revised Code to require state 2
agencies, state institutions of higher education, 3
school districts, and community schools to comply 4
with certain energy and environmentally efficient 5
building standards, and to require the Director of 6
Development to adopt those standards by rule.7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 153.03, 1551.17, 3313.377, and 8
3314.042 of the Revised Code be enacted to read as follows:9

       Sec. 153.03. (A) As used in this section:10

       (1) "State building" means any building owned or operated, in 11
whole or in part, by a state agency.12

       (2) "State agency" means every department, bureau, board, 13
commission, office, agency, or other organized body established by 14
the constitution or laws of this state for the exercise of any 15
function of state government, including, but not limited to, the 16
general assembly, legislative agencies, the supreme court, the 17
court of claims, and state-supported institutions of higher 18
education as defined in section 3345.12 of the Revised Code.19

       (B) On and after the effective date of the rules the director 20
of development adopts under section 1551.17 of the Revised Code, 21
all state buildings whose construction or renovation is regulated 22
by a building code adopted pursuant to division (A) of section 23
3781.10 of the Revised Code shall be designed, constructed, 24
renovated, and maintained in compliance with the rules.25

       Sec. 1551.17. The director of development shall adopt rules 26
in accordance with Chapter 119. of the Revised Code that comply 27
with the leadership in energy and environmental design (LEED) 28
green building rating system silver certification of the United 29
States green building council for purposes of the design, 30
construction, renovation, and maintenance of all state buildings 31
and school buildings covered by section 153.03, 3313.377, or 32
3314.042 of the Revised Code.33

       Sec. 3313.377. (A) As used in this section, "school building" 34
means any building owned or operated, in whole or in part, by the 35
board of education of any city, local, exempted village, or joint 36
vocational school district or by the governing board of an 37
educational service center.38

       (B) On and after the effective date of the rules the director 39
of development adopts under section 1551.17 of the Revised Code, 40
all school buildings whose construction or renovation is regulated 41
by a building code adopted pursuant to division (A) of section 42
3781.10 of the Revised Code shall be designed, constructed, 43
renovated, and maintained in compliance with the rules.44

       Sec. 3314.042. (A) As used in this section, "school building" 45
means any building owned or operated, in whole or in part, by the 46
governing authority of a community school established under this 47
chapter other than an internet- or computer-based community 48
school.49

       (B) On and after the effective date of the rules the director 50
of development adopts under section 1551.17 of the Revised Code, 51
all school buildings whose construction or renovation is regulated 52
by a building code adopted pursuant to division (A) of section 53
3781.10 of the Revised Code shall be designed, constructed, 54
renovated, and maintained in compliance with the rules.55
