A BILL
To amend section 2927.01 of the Revised Code to 1
prohibit engaging in sexual conduct with a human 2
corpse.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 2927.01 of the Revised Code be 4
amended to read as follows:5

       Sec. 2927.01.  (A) No person, except as authorized by law, 6
shall treat a human corpse in a way that the person knows would 7
outrage reasonable family sensibilities.8

       (B) No person, except as authorized by law, shall treat a 9
human corpse in a way that would outrage reasonable community 10
sensibilities.11

       (C) No person shall engage in sexual conduct, as defined in 12
section 2907.01 of the Revised Code, with a human corpse.13

       (D) Whoever violates division (A) of this section is guilty 14
of abuse of a corpse, a misdemeanor of the second degree. Whoever 15
violates division (B) of this section is guilty of gross abuse of 16
a corpse, a felony of the fifth degree. Whoever violates division 17
(C) of this section is guilty of necrophilia, a felony of the 18
third degree.19

       Section 2. That existing section 2927.01 of the Revised Code 20
is hereby repealed.21
