A BILL
To enact sections 153.03, 1551.17, 3313.377, and 3314.042 of the Revised Code to require state agencies, state institutions of higher education, school districts, and community schools to comply with certain energy and environmentally efficient building standards, and to require the Director of Development to adopt those standards by rule.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That sections 153.03, 1551.17, 3313.377, and 3314.042 of the Revised Code be enacted to read as follows:
Sec. 153.03. (A) As used in this section:
(1) "State building" means any building owned or operated, in whole or in part, by a state agency.
(2) "State agency" means every department, bureau, board, commission, office, agency, or other organized body established by the constitution or laws of this state for the exercise of any function of state government, including, but not limited to, the general assembly, legislative agencies, the supreme court, the court of claims, and state-supported institutions of higher education as defined in section 3345.12 of the Revised Code.
(B) On and after the effective date of the rules the director of development adopts under section 1551.17 of the Revised Code, all state buildings whose construction or renovation is regulated by a building code adopted pursuant to division (A) of section 3781.10 of the Revised Code shall be designed, constructed, renovated, and maintained in compliance with the rules.
Sec. 1551.17. The director of development shall adopt rules in accordance with Chapter 119. of the Revised Code that comply with the leadership in energy and environmental design (LEED) green building rating system silver certification of the United States green building council for purposes of the design, construction, renovation, and maintenance of all state buildings and school buildings covered by section 153.03, 3313.377, or 3314.042 of the Revised Code.
Sec. 3313.377. (A) As used in this section, "school building" means any building owned or operated, in whole or in part, by the board of education of any city, local, exempted village, or joint vocational school district or by the governing board of an educational service center.
(B) On and after the effective date of the rules the director of development adopts under section 1551.17 of the Revised Code, all school buildings whose construction or renovation is regulated by a building code adopted pursuant to division (A) of section 3781.10 of the Revised Code shall be designed, constructed, renovated, and maintained in compliance with the rules.
Sec. 3314.042. (A) As used in this section, "school building" means any building owned or operated, in whole or in part, by the governing authority of a community school established under this chapter other than an internet- or computer-based community school.
(B) On and after the effective date of the rules the director of development adopts under section 1551.17 of the Revised Code, all school buildings whose construction or renovation is regulated by a building code adopted pursuant to division (A) of section 3781.10 of the Revised Code shall be designed, constructed, renovated, and maintained in compliance with the rules.
