A BILL
To amend section 5502.99 and to enact section 5502.371 of the Revised Code to prohibit the confiscation of lawfully owned and carried firearms during a state of emergency.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 5502.99 be amended and section 5502.371 of the Revised Code be enacted to read as follows: Sec. 5502.371. No law enforcement officer, person acting as a law enforcement officer, or other public official shall confiscate or attempt to confiscate any lawfully carried or lawfully owned firearm in this state during a declared state of emergency. Sec. 5502.99. (A) Whoever violates
division (A) of
section 5502.37 of the Revised Code shall
be fined fifty dollars
or imprisoned for not less than sixty days, or both. (B) Whoever violates division (B) of section
5502.37 of
the Revised Code shall be fined not less than five thousand nor
more than ten thousand dollars, or imprisoned for not less than
one nor more than five years, or both. (C) Whoever violates division (C) or (D) of section
5502.37 of the Revised Code shall be
fined not less
than
two thousand nor more than five thousand dollars, or imprisoned
for not less than one nor more than five years, or both. (D) Except as provided in divisions (A), (B), and (C) of
this section and unless another penalty is provided by the laws
of this state, whoever violates sections
5502.21 to 5502.37 of
the Revised Code, or any other law enacted, adopted, or issued
pursuant to those sections, shall be fined not more than fifty
dollars or imprisoned for not more than sixty days, or both. (E) Whoever violates section 5502.371 of the Revised Code is guilty of a felony of the fifth degree and shall be fined not less than five thousand dollars or imprisoned for not less than six months or both. Section 2. That existing section 5502.99 of the Revised Code is hereby repealed. |
